Spotlight on the so-called « EL KHOMRI LAW »,
the law on work, modernization of the social dialogue and safeguarding of professional career paths

 

The law on work, modernization of the social dialogue and safeguarding of professional career paths, also so-called “Work law” or “El Khomri law”, has been entered in force on August 10, 2016 further to its publication in the Journal Officiel and its compliance statement by the Constitutional Council on August 4, 2016.

The global goal of this law aims at softening many rules of the French Labor Code by focusing on the recourse to the collective bargaining at the company level, notably concerning the working time, in order to reinforce the competitiveness of the economy and develop employment while offering best protection for workers and especially for those, who are in a precarious situation.

Many articles will be applicable only after the publication of implementing decrees, which will specify several schemes resulting from the new legislation. Indeed, at least 141 decrees are expected in the weeks and months to come to make the provisions of the law be effective as from January 1st, 2017.
